These Terms of Service ("Terms") govern your access to and use of www.everystamp.store (the "Site") and your purchase of products from Every Stamp Pte. Ltd., a company incorporated in Singapore ("Every Stamp", "we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate and complete.

2. Our Products

Our custom stamps are individually manufactured to your design. No two orders are identical, and slight variations from on-screen previews are normal due to the physical engraving and manufacturing process. Fine details in a design may be adapted where reasonably necessary to ensure a clean, usable impression. Such variations and adaptations do not constitute a defect.

3. Orders and Acceptance

Your order constitutes an offer to purchase. A contract is formed only when we accept your order by sending an order confirmation email. We may decline or cancel an order at our discretion, including where we cannot lawfully or practically produce the requested design, in which case any payment made will be refunded in full.

4. Artwork and Intellectual Property

• Your ownership. You keep full ownership of all artwork, logos, images, and text you upload. By submitting artwork, you grant us a limited, non-exclusive license to reproduce and technically adapt it solely for the purpose of designing, proofing, and manufacturing your order. We never sell, license, publish, or reuse your artwork for any other purpose.
• Your warranty. You confirm that you own the artwork you upload or hold all rights and permissions necessary to use it, and that its use does not infringe the intellectual property or other rights of any third party.
• Our materials. All content on the Site (excluding customer artwork), including text, images, page designs, and branding, belongs to Every Stamp or its licensors and may not be reproduced without our written consent.

5. Prohibited Designs

We may refuse, cancel, and refund any order that, in our reasonable judgment, involves:

• government, court, notarial, or other official seals or marks, unless you demonstrate lawful authority to use them;
• reproductions of another person's signature without their documented authorization;
• currency, banknotes, postage, or security instruments;
• content that infringes third-party trademarks or copyrights; or
• content that is unlawful, deceptive, or intended to facilitate fraud or forgery.

6. Proofs and Approval

For custom orders we prepare a digital proof for your review. Please check it carefully: spelling, numbers, layout, and orientation are your responsibility once approved, and errors approved by you are not defects. If you do not respond to a proof within 7 days, we may pause your order until we hear from you. Production begins only after proof approval, not at checkout.

7. Pricing and Payment

Prices are shown in US dollars (USD) unless stated otherwise and may change at any time. The price displayed at checkout is the price you pay. Payment is due at the time of order and is processed by secure third-party payment providers. We reserve the right to correct obvious pricing errors; if we do so before production, you may cancel for a full refund.

8. Production, Shipping, and Delivery

Production timelines start from proof approval. Estimated delivery dates are good-faith estimates only; carriers may experience delays beyond our control, and such delays do not entitle you to cancel an order already in production. Risk in the products passes to you on delivery. Any customs duties, import taxes, or brokerage fees charged by the destination country are the recipient's responsibility.

9. Cancellations

You may cancel an order free of charge at any time before production begins (normally, while your order is at the proof stage). Once engraving or manufacturing has started, the order can no longer be cancelled, as the product is custom-made for you.

10. Returns, Remakes, and Refunds

Because custom stamps are made to your specifications, we cannot accept change-of-mind returns on custom or personalized products. If an item arrives damaged, defective, or materially different from the approved proof, we will remake it free of charge or refund it in accordance with our Return and Refund Policy, which forms part of these Terms. Eligible non-personalized items (such as ink pads and accessories) may be returned as set out in that policy.

11. Acceptable Use of the Site

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping content, or using it for any unlawful purpose. We may suspend or terminate access for breach of these Terms.

12. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components. Nothing in this section limits the warranties and remedies that applicable consumer law provides and that cannot be excluded.

13. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses, loss of profits, loss of business, or loss of data. Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for any liability that cannot be excluded under applicable law, including your non-excludable rights under the Consumer Protection (Fair Trading) Act 2003 of Singapore or the mandatory consumer laws of your country of residence.

14. Indemnity

You agree to indemnify Every Stamp against claims, losses, and reasonable costs arising from artwork or content you supplied in breach of Section 4 or Section 5, including third-party intellectual property claims.

15. Privacy

Our collection and use of personal data, including your uploaded artwork, is described in our Privacy Policy, which forms part of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time you place an order is the version that applies to that order.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Singapore. The courts of Singapore have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site, except where the mandatory consumer protection laws of your country of residence give you the right to bring proceedings in your local courts.
